Terms of Service
Last updated · August 5, 2026
These terms govern your use of Nick's Auto Transport and the auto-transport brokerage services we provide. By requesting an estimate or booking a shipment, you agree to these terms.
§ 1
Who we are
Nick's Auto Transport is a licensed property broker authorized by the U.S. Department of Transportation (USDOT 4535826, MC 1799220). We arrange motor-carrier services between you and federally authorized carriers; we are not the carrier ourselves.
§ 2
Estimates and quotes
Our published numbers are estimates, not guaranteed prices. Estimates are valid for 72 hours from issuance and reflect typical market conditions for the route, vehicle, and transport type provided. Final pricing depends on carrier availability, fuel, lane demand, and any condition or access factors disclosed only after the request is submitted.
A booking is confirmed only once both parties have agreed in writing (including SMS) and a carrier has been dispatched to the shipment.
§ 3
Your price and what it includes
The total we quote is the complete price for your shipment. It covers both the motor carrier's transport charge and our brokerage service: sourcing and vetting the carrier, verifying their operating authority and insurance, dispatching the load, coordinating pickup and delivery, monitoring the shipment in transit, and advocating for you if a claim arises. We do not bill a separate broker fee on top of the quoted total.
Nothing is due to the driver at pickup or at delivery. The quoted total is paid to us, and we pay the carrier.
Once you book, that total is the amount you authorize and the amount we charge. Two things can change a booked price. The first is a change to the shipment itself, such as a different pickup or delivery location, a different or additional vehicle, or a vehicle that is not in the condition described, for example one that will not start or roll. The second is an unusual change in market conditions on your route, such as fuel costs, carrier availability, or seasonal demand moving enough that no carrier will accept the shipment at the quoted price. The second is uncommon.
In either case we will contact you before any different amount is charged, and no revised price takes effect without your agreement. If you do not agree, you may cancel at no cost at any time before a carrier is assigned to your shipment.
§ 4
Carrier responsibility and insurance
The carrier we dispatch is responsible for the safe transport of your vehicle and carries motor-carrier liability insurance (typically $100,000+ for cargo coverage). You will receive the carrier's name, MC number, and insurance details before pickup.
As broker, we coordinate the move and advocate for you in the event of a claim, but the carrier is the party legally responsible for the vehicle while it is in their custody.
§ 5
Pickup and delivery
Pickup and delivery windows are estimated, not guaranteed. Carriers are subject to weather, traffic, mechanical events, federal hours-of-service rules, and the schedules of other shippers on the same load. We will keep you informed of material changes as we receive updates from the driver.
You or an authorized representative must be present at pickup and delivery to inspect the vehicle and sign the Bill of Lading. The condition report on the Bill of Lading is the official record of the vehicle's state at pickup and delivery.
§ 6
Payment
When you reserve a shipment, your payment method is saved securely to confirm your reservation and lock in your quoted price — nothing is charged at booking. With your authorization, the quoted total is charged to your saved payment method when a carrier is assigned to your shipment. Where we agree to a different arrangement (including payment collected in full at booking), that arrangement is presented during booking. Accepted payment methods are presented during booking.
Returned payments, disputes, and chargebacks may incur additional fees and may result in suspension of service.
§ 7
Cancellation
You may cancel without charge any time before a carrier has been dispatched to your shipment. Once dispatched, the carrier's cancellation terms apply — typically a flat fee or a percentage of the agreed transport price, depending on how close pickup is.
§ 8
Claims and damage
Note all damage on the Bill of Lading at delivery. Claims must be submitted to the carrier's insurance within the timeline specified on the Bill of Lading (typically nine months from delivery). We will assist you with claim documentation and communication with the carrier.
§ 9
Prohibited items
The vehicle must be free of personal property at pickup beyond the carrier's allowed limit (typically 100 lbs, secured in the trunk). Hazardous materials, firearms, illegal goods, and items of extraordinary value (cash, jewelry, art) are never allowed. Personal property is not covered by the carrier's cargo insurance.
§ 10
Limitation of liability
Our liability as broker is limited to the broker fee paid to us. We are not the carrier and are not responsible for the carrier's actions or omissions. Carrier liability is governed by federal motor carrier law and the carrier's insurance policy.
§ 11
SMS text messaging program
When you opt in to text messages from Nick's Auto Transport — by checking the SMS consent box on our estimate form, or by texting us first — we send service and account messages related to your request: your estimate and quote link, booking confirmations, driver assignment and payment confirmations, pickup and delivery status updates, replies to your questions, and occasional follow-ups about a quote or reservation you started. Message frequency varies with your transport activity.
- Opting out: Text STOPat any time to cancel; you'll receive one final message confirming the opt-out. Text HELP for help, or call 1-866-512-1871.
- Rates: Message and data rates may apply depending on your mobile plan. Nick's Auto Transport does not charge for text messages.
- Eligibility: The SMS program is intended for individuals 18 years of age or older. By opting in, you confirm you are 18+ and the subscriber or customary user of the phone number provided.
- Carrier disclaimer: Wireless carriers are not liable for delayed or undelivered messages.
- Consent: Consent to receive text messages is not a condition of purchasing any service. See our Privacy Policy for how we handle your information — mobile opt-in data is never shared with third parties for marketing.
§ 12
Communications consent
When you give us your phone number and check the consent box on one of our forms, you consent to receive communications from Nick's Auto Transport at that number — including marketing and promotional messages — by both text message and phone call, and you agree those messages and calls may be made using automated technology and may use an artificial, pre-recorded, or AI-generated voice. Consent is not a condition of purchasing any service from us.
Message frequency varies, and message & data rates may apply. Reply STOP to a text to unsubscribe or HELP for help; to stop calls, tell our representative or automated assistant to stop calling, or contact us at 1-866-512-1871. Revoking consent through any channel stops both automated calls and texts to your number, and an opt-out always overrides any prior consent. See our Privacy Policy for full details.
§ 13
Governing law
These terms are governed by the laws of the State of Texas. Any dispute will be resolved in the state or federal courts located in Travis County, Texas, unless we mutually agree otherwise in writing.
§ 14
Changes
We may update these terms from time to time. The current version will always be posted at this URL with the “Last updated” date above. Continued use of our service after changes are posted constitutes acceptance.
