Terms of Service

These terms govern your use of Nick's Auto Transport and the auto-transport brokerage services we provide. By requesting an estimate or booking a shipment, you agree to these terms.
§ 1
Who we are
Nick's Auto Transport is a licensed property broker authorized by the U.S. Department of Transportation (USDOT 3309780). We arrange motor-carrier services between you and federally authorized carriers; we are not the carrier ourselves.
§ 2
Estimates and quotes
Our published numbers are estimates, not guaranteed prices. Estimates are valid for 24 hours from issuance and reflect typical market conditions for the route, vehicle, and transport type provided. Final pricing depends on carrier availability, fuel, lane demand, and any condition or access factors disclosed only after the request is submitted.
A booking is confirmed only once both parties have agreed in writing (including SMS) and a carrier has been dispatched to the shipment.
§ 3
Carrier responsibility and insurance
The carrier we dispatch is responsible for the safe transport of your vehicle and carries motor-carrier liability insurance (typically $100,000+ for cargo coverage). You will receive the carrier's name, MC number, and insurance details before pickup.
As broker, we coordinate the move and advocate for you in the event of a claim, but the carrier is the party legally responsible for the vehicle while it is in their custody.
§ 4
Pickup and delivery
Pickup and delivery windows are estimated, not guaranteed. Carriers are subject to weather, traffic, mechanical events, federal hours-of-service rules, and the schedules of other shippers on the same load. We will keep you informed of material changes as we receive updates from the driver.
You or an authorized representative must be present at pickup and delivery to inspect the vehicle and sign the Bill of Lading. The condition report on the Bill of Lading is the official record of the vehicle's state at pickup and delivery.
§ 5
Payment
Unless otherwise agreed, payment is due to the carrier at delivery in the form specified during booking (typically cash, cashier's check, or money order; some carriers accept card). Any broker fee is collected separately by us at dispatch.
Returned payments, disputes, and chargebacks may incur additional fees and may result in suspension of service.
§ 6
Cancellation
You may cancel without charge any time before a carrier has been dispatched to your shipment. Once dispatched, the carrier's cancellation terms apply — typically a flat fee or a percentage of the agreed transport price, depending on how close pickup is.
§ 7
Claims and damage
Note all damage on the Bill of Lading at delivery. Claims must be submitted to the carrier's insurance within the timeline specified on the Bill of Lading (typically nine months from delivery). We will assist you with claim documentation and communication with the carrier.
§ 8
Prohibited items
The vehicle must be free of personal property at pickup beyond the carrier's allowed limit (typically 100 lbs, secured in the trunk). Hazardous materials, firearms, illegal goods, and items of extraordinary value (cash, jewelry, art) are never allowed. Personal property is not covered by the carrier's cargo insurance.
§ 9
Limitation of liability
Our liability as broker is limited to the broker fee paid to us. We are not the carrier and are not responsible for the carrier's actions or omissions. Carrier liability is governed by federal motor carrier law and the carrier's insurance policy.
§ 10
Governing law
These terms are governed by the laws of the State of Texas. Any dispute will be resolved in the state or federal courts located in Travis County, Texas, unless we mutually agree otherwise in writing.
§ 11
Changes
We may update these terms from time to time. The current version will always be posted at this URL with the “Last updated” date above. Continued use of our service after changes are posted constitutes acceptance.
